Despite IIT-JEE errors, no SC stay on results

The Supreme Court on Tuesday refused to stay the declaration of the IIT entrance exam result, scheduled to be declared on Wednesday, on the plea that wrong answers were included in the question paper this year, saying it might jeopardise the chances of many students.

“We are not going to consider the stay of the results.
The question does not arise,“ a vacation bench of Justices G.S. Singhvi and C.K. Prasad told senior advocate Mr Nidesh Gupta, who took up a petition of some students from Kanpur. However, the bench permitted the students to make the representation to the director of IIT Kanpur, who would consider their applications within seven days of the receipt and form any opinion on them.

The Supreme Court said that the remedy of judicial review is always open to the students after declaration of the result, if they feel that their papers had not been properly assessed.

Mr Gupta while explaining the methodology of negative marks and its impact on the career of a student aspiring to get into the IITs, said the IIT board had itself admitted that certain questions carrying a total of 36 marks, had “wrong“ answers and all the students who had attempted them would get 36 marks.

He pointed that awarding of 36 marks as compensation to the wrong answers would affect those students who had not attempted them fearing negative marking.
