HYDERABAD: A Division Bench of the High Court comprising Chief Justice Nissar Ahmed Kakru and Justice Vilas Afzalpurkar, on Wednesday, vacated the interim orders which stayed the operation of Government Orders 55 and 61 for rationalising posting of teachers.These interim orders were given last week in a writ petition filed by the Andhra Pradesh Teachers Federation. The Federation contended that the GOs were in violation of the Right to Education Act and in the name of rationalisation the students were being denied schooling.The government filed the petition to vacate the interim orders. It was averred that the whole system is being streamlined and the petitioners have no right to file such a case. The Bench heard the counsel for the government and the counsel for the petitioner and felt that the stay is not to be continued.Our Special Correspondent adds: The High Court's order came as a big relief to the government as it could now go ahead with its exercise to rationalise the appointments of teachers to ensure proper student-teacher ratio in schools as stipulated under the Right to Education Act.A senior official in the Education Department said the government wanted to undertake the rationalisation exercise because its teachers were disproportionately posted, resulting in shortage of teachers where there were many students and vice versa.He said a survey conducted by the government before the rationalisation was taken up had revealed that at least 25,000 teachers were found in excess of the requirements in the State. The official said transfers of teachers would be continued as per requirements of the schools now that the stay had been vacated. Before the High Court issued the stay, some teachers were already shifted.
